1. Agreement to Terms
By accessing or using Check on Mine ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Check on Mine is a personal safety monitoring service that:
- Tracks user activity patterns and wellness indicators
- Sends alerts to designated emergency contacts when irregularities are detected
- Provides location sharing and trip monitoring features
- Offers SOS/panic button functionality
- Supports medication tracking and reminders
Important: Check on Mine is not a replacement for emergency services. In life-threatening situations, always call 911 or your local emergency number directly.
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age, or have parental/guardian consent
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable laws
4. Account Registration
When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information as needed
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
5. User Responsibilities
You are responsible for:
- Ensuring your device has adequate battery, connectivity, and location services enabled
- Obtaining consent from all emergency contacts you add
- Responding to check-in requests in a timely manner
- Keeping your emergency contact information accurate and up-to-date
- Using the Service in accordance with our Acceptable Use Policy
6. Emergency Contact Consent
By adding emergency contacts, you represent and warrant that:
- You have obtained explicit consent from each contact
- Contacts understand they may receive alerts via SMS, email, or push notification
- Contacts agree to receive location information during emergencies
- You will remove contacts promptly upon their request
7. SMS/Text Message Consent and Terms
By providing your phone number and using Check on Mine, you expressly consent to receive SMS text messages and voice calls from Check on Mine.
7.1 Types of Messages
You may receive the following types of SMS messages:
- Safety Alerts: Notifications when your emergency contacts miss check-ins or trigger SOS
- Check-in Reminders: Periodic reminders to confirm your safety status
- Medication Reminders: Notifications for scheduled medication doses
- Emergency Notifications: Critical alerts during SOS or emergency situations
- Account Notifications: Verification codes, password resets, and security alerts
7.2 Message Frequency
Message frequency varies based on your settings and activity. You may receive:
- Check-in reminders: Up to 4 times daily (configurable)
- Medication reminders: Based on your medication schedule
- Emergency alerts: As needed during emergencies
- Account messages: Occasional, as needed
7.3 Message and Data Rates
Standard message and data rates may apply. Check with your carrier for details. Check on Mine does not charge for SMS messages, but your carrier may.
7.4 Opting Out
You can opt out of SMS messages at any time by:
- Replying STOP to any message from Check on Mine
- Updating your notification preferences in the app settings
- Contacting support at support@checkonmine.com
After opting out, you will receive one confirmation message. Reply START to resubscribe at any time.
Note: Opting out of SMS may limit the Service's ability to alert you or your emergency contacts during emergencies. Critical safety alerts may still be delivered via other methods (push notification, email).
7.5 Emergency Contact SMS Consent
When you add an emergency contact, they will receive an SMS message explaining the service and requesting their consent. Emergency contacts must confirm consent before receiving any further messages. Emergency contacts can opt out at any time by replying STOP.
7.6 Carrier Liability
Carriers are not liable for delayed or undelivered messages. Check on Mine is not responsible for messages that fail to deliver due to carrier issues, invalid phone numbers, or phone settings.
8. Service Limitations and Disclaimers
You acknowledge and agree that:
- The Service depends on internet connectivity, GPS accuracy, and device functionality
- Alerts may be delayed or fail due to network issues beyond our control
- Location data may be inaccurate depending on environmental factors
- The Service is not a medical device and should not replace professional medical monitoring
- We do not guarantee that emergency contacts will receive or respond to alerts
9. Subscription and Payments
If you subscribe to paid features:
- Subscription fees are billed in advance on a recurring basis
- You authorize us to charge your payment method automatically
- Refunds are provided in accordance with our refund policy
- We may change pricing with 30 days notice
10. Intellectual Property
All content, features, and functionality of the Service are owned by Check on Mine and protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or distribute any part of the Service
- Reverse engineer or attempt to extract source code
- Use our trademarks without written permission
- Remove any copyright or proprietary notices
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
- WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS
12. Indemnification
You agree to indemnify and hold harmless Check on Mine, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit through the Service
13. Termination
We may terminate or suspend your account:
- For violations of these Terms or our Acceptable Use Policy
- If required by law or legal process
- If we discontinue the Service
- At our sole discretion with reasonable notice
You may terminate your account at any time through the app settings or by contacting support.
14. Governing Law
These Terms are governed by the laws of the State of Alabama, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Mobile County, Alabama.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the modified Terms.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Check on Mine regarding the Service.
